A hostile work environment exists when cumulative unwelcome comments or behavior unreasonably alter an employee’s terms or conditions of employment, creating a “hostile” or offensive work environment. For employment law purposes, these comments or behaviors must be discriminatory in nature; i.e., based on race, religion, sex, sexual orientation, gender identity, national origin, age, disability, gender, veteran status, etc. Typically the behaviors have to be recurring and so severe in nature that the employee feels they are unable to perform their job responsibilities.
